Jurors best remember what they hear in the beginning and end of opening statement, at the A and D points. Attention drops dramatically during the middle of opening statement, between B and C.

To take advantage of this fact, try the following strategies:

  • Tell your audience the important points at the beginning of opening - in your introduction - and at the end - in your summary
  • Do not introduce new information in the body of your opening
  • Design as many beginnings and endings as possible:
  • Divide your opening into segments of not more than 20 minutes each
  • Use visuals to create the transitions between segments
  • Treat each segment as a new topic, with its own beginning and ending
  • Announce to the jurors when you are beginning and ending each segment
Organizing your opening to match the jurors' retention curve allows you to communicate your message more effectively and enjoy more successful outcomes.
